The All India Association of Postal Drivers&Artisans (AIAPDA) respectfully submits this representation on behalf of the Skilled Artisans serving in and retired from various Mail Motor Service Units across the Department of Posts.

2. The Hon'ble High Court of Kerala, in its judgment dated 24.06.2025 in OP (CAT) No.34 of 2024, has upheld the entitlement of Shri K. Ganesan, Painter, Kerala Mail Motor Service, to the correct ACP-II pay scale of Rs.5000-150-8000 (5th CPC) with the corresponding Grade Pay of Rs.4200 in Pay Band-2 under the CCS (Revised Pay) Rules, 2008.

3. The judgment has interpreted the relevant provisions of the DOP&T ACP Scheme and the CCS (Revised Pay) Rules, 2008. Therefore, the issue is not confined to one individual or one Circle. It concerns the uniform implementation of statutory service rules applicable to all similarly placed Skilled Artisans in the Department of Posts.

4. Unfortunately, in several Mail Motor Service Units, ACP-II was granted in the lower pay scale of Rs.4500-125-7000, corresponding to Grade Pay Rs.2800 in PB-1, instead of the correct corresponding pay structure.

As a consequence:

ACP-II pay fixation was made in an incorrect corresponding pay scale. 

MACP benefits were also fixed at a lower Grade Pay. 

Employees and pensioners have suffered recurring financial loss affecting pay, pension and retirement benefits. 

5. It is a well-settled principle of service jurisprudence that when the provisions of statutory rules are interpreted by a Constitutional Court, the benefit should ordinarily be extended to all similarly situated employees. Compelling every employee or pensioner to approach different judicial forums on the same issue results in avoidable litigation, administrative expenditure and unnecessary hardship.

6. Further, Articles 14 and 16 of the Constitution of India mandate equality before law and equal treatment in public employment. Employees performing identical duties under the same statutory rules cannot be subjected to different pay fixation merely because they belong to different Postal Circles.

7. In these circumstances, AIAPDA respectfully requests the Department to issue a uniform Directorate-level clarification/order extending the benefit of the above judgment to all similarly placed Skilled Artisans throughout India.

AIAPDA therefore humbly prays that:

1. The Department may examine the implementation of the judgment of the Hon'ble High Court of Kerala in OP (CAT) No.34 of 2024. 

2. A Directorate clarification may be issued declaring that the correct ACP-II pay scale is Rs.5000-150-8000 (5th CPC) with the corresponding Grade Pay of Rs.4200 in PB-2 (6th CPC) wherever applicable under the DOP&T ACP Scheme. 

3. Consequential revision of MACP benefits, including placement in the next higher Grade Pay wherever due under the applicable rules, may also be ordered. 

4. The benefit may be extended suo motu to all serving employees and pensioners similarly placed throughout the Department of Posts, without compelling them to approach the Courts individually. 

5. Arrears of pay, revision of pension and all consequential monetary benefits may be sanctioned in accordance with law. 

AIAPDA sincerely believes that extending the benefit uniformly will uphold the principles of equality, ensure faithful implementation of the DOP&T Scheme, and substantially reduce avoidable litigation against the Department.

"The Association further requests that this issue may also be examined by the Department of Posts – Pay Commission Cell, so that the anomaly in the corresponding pay scale under the ACP Scheme and its consequential impact on MACP and pension may be rectified uniformly for all similarly placed employees and pensioners across the Department."
